By accessing or using the Acrez Platform in any manner including browsing, registering, listing, or subscribing, confirm that you have read, understood, and agree to be legally bound by these Terms and Conditions and our Privacy Policy. If you do not agree, you must immediately discontinue use of the Platform.

1. DEFINITIONS

1.1 Platform

Refers to the Acrez website (www.Acrez.co), mobile applications (iOS and Android), APIs, and any other digital interface or technology, whether currently existing or developed in the future, owned, operated, or managed by Shashwat Technologies, for the purpose of facilitating agricultural and rural land discovery and related services in India.

1.2 User

Any natural person or legal entity who accesses, browses, registers on, or uses the Platform in any capacity — including landowners, sellers, agents, brokers, institutional investors, or individual buyers — whether or not registered, and whether acting in a personal or professional capacity.

1.3 Listing Party

Any individual, landowner, agent, broker, or legal entity that submits, uploads, or otherwise makes available land listings on the Platform, either directly or through duly authorised representatives.

1.4 Services

All features, tools, functionalities, and offerings provided through the Platform, including but not limited to: map-based listing and discovery, property search, government data overlays, satellite imagery access, listing verification, subscription management, and customer support.

1.5 Content

All data, text, photographs, videos, graphics, maps, pricing details, contact information, branding elements, metadata, GIS overlays, User submissions, and any other materials published, displayed, transmitted, or stored on the Platform.

1.6 Verified Listing

A listing that has undergone Acrez's preliminary internal review process, which includes: document submission check, seller identity verification, and survey number cross-reference. A "Verified" badge indicates completion of this internal process only. It does not constitute a legal certification of title, confirmation of absence of encumbrances, or a guarantee of marketability. Users must conduct independent legal and technical due diligence prior to any transaction.

1.7 Government Data Plans

A feature available exclusively to paid subscribers that displays publicly available government data — including land survey maps, road and highway plans, government schemes, and district development records. This data is sourced from publicly available records on a best-effort basis and is for general informational purposes only.

1.8 Subscription

A paid access tier (Monthly or Annual) that grants enhanced Platform features including expanded contact access, Government Data Plans, and latest satellite imagery, subject to fair use limits as described in Section 6.

2. PLATFORM OVERVIEW & ACCESS

2.1 Nature of Platform

Acrez is a technology-driven digital marketplace that facilitates the discovery and listing of agricultural land parcels across India. Acrez connects landowners, agents, and buyers through verified, map-first listings. Acrez is a private platform and is not affiliated with, endorsed by, or representative of any government authority, statutory body, or department.

2.2 RERA Position

Acrez is a technology platform that facilitates listing and discovery of land parcels. It does not engage in brokerage, real estate agency, or property development activities, and is not registered under the Real Estate (Regulation and Development) Act, 2016 (RERA). No agency, fiduciary, or principal-agent relationship arises between Acrez and any User or Listing Party through use of the Platform.

2.3 User Eligibility

Use of the Platform is restricted to individuals and entities legally competent to enter into contracts under the Indian Contract Act, 1872. Users must be at least 18 years of age. By using the Platform, you represent and warrant that you satisfy these eligibility requirements.

2.4 Account Registration and Security

Certain features require User registration. You are solely responsible for maintaining the confidentiality of your login credentials, all activities conducted under your account, and ensuring all registration information is accurate, current, and complete. You must notify Acrez immediately of any unauthorised use or suspected security breach at support@acrez.co. Acrez shall not be liable for losses arising from failure to maintain account security.

2.5 Lawful Use

Users shall access and use the Platform strictly for lawful, authorised, and bona fide purposes in accordance with applicable laws of India. Prohibited activities include but are not limited to: unauthorised access attempts, misrepresentation of identity, dissemination of false or misleading information, automated data extraction, and transmission of unsolicited commercial communications.

2.6 Access Suspension and Termination

Acrez reserves the right, at its sole discretion, to suspend, restrict, or permanently terminate any User's access to the Platform without prior notice or liability, in the event of violation of these Terms, misuse of the Platform, conduct deemed unlawful, abusive, or fraudulent, or any activity detrimental to the Platform, its Users, or third parties. No refund shall be due upon termination for cause.

2.7 Amendments to Terms

Acrez may amend, modify, or update these Terms at any time. Revised Terms shall be effective upon publication on the Platform. Continued use after publication constitutes deemed acceptance of updated Terms. Users are advised to review these Terms periodically. Material changes affecting paid subscribers will be notified via registered email where feasible.

2.8 Grievance Redressal

For complaints or grievances relating to the Platform or its Content, Users may contact the Grievance Officer at support@acrez.co. Acrez will use commercially reasonable efforts to address grievances within fourteen (14) working days of receipt.

2.9 Force Majeure

Acrez shall not be liable for any delay or failure in performance due to circumstances beyond its reasonable control, including natural disasters, server failures, cyberattacks, pandemics, legal or regulatory changes, or government actions. Acrez will make reasonable efforts to restore Services. Users agree the Platform bears no responsibility for losses arising from such disruptions.

3. DATA PROTECTION AND PRIVACY

3.1 Data Collection and Consent

By accessing or using the Platform, Users expressly consent to the collection, storage, and processing of personal data in accordance with Acrez's Privacy Policy, which forms an integral part of these Terms and is available at www.Acrez.co/privacy. Continued use constitutes deemed acceptance.

3.2 DPDP Act Compliance

Acrez processes personal data in compliance with the Digital Personal Data Protection Act, 2023 (DPDP Act) and all rules framed thereunder. As a Data Fiduciary, Acrez shall: collect only data necessary for Platform functionality; retain data only for as long as necessary; and implement reasonable security safeguards. Users (as Data Principals) have the right to: access information about their data being processed; seek correction or erasure of personal data; and withdraw consent, subject to applicable legal obligations. Requests may be submitted to support@acrez.co.

3.3 Cookies and Analytics

The Platform uses cookies, pixels, and analytics tools to enhance functionality, monitor performance, and improve User experience. Users may manage cookie preferences via browser settings; however, disabling certain cookies may impair Platform functionality.

3.4 Third-Party Services

Acrez integrates third-party services including mapping tools (e.g., Google Maps), payment gateways, and analytics platforms. Such services are governed by their respective terms and privacy policies. Acrez disclaims liability for any downtime, inaccuracy, or data handling by third-party providers.

3.5 Data Security

Acrez adopts reasonable technical and organisational measures to protect User data. Acrez shall not be held liable for breaches that occur despite such precautions and are beyond its reasonable control. Users are advised to use strong credentials and not share account access.

3.6 Prohibition on Automated Extraction

Any form of automated data extraction from the Platform — including scraping, crawling, data mining, or bot-based access — is strictly prohibited. Such actions constitute a material breach of these Terms and may attract legal proceedings including injunctive relief and claims for damages.

3.7 Intellectual Property

All proprietary Content on the Platform — including text, images, branding elements, software architecture, GIS overlays, and the Acrez wordmark and logo — is the exclusive intellectual property of Shashwat Technologies, protected under applicable copyright, trademark, and design laws of India. Unauthorized use, reproduction, or distribution is strictly prohibited and may result in legal action.

4. LISTINGS, VERIFICATION & TAGS

4.1 Nature of Listings

All listings displayed on the Platform are submitted by Users, including landowners, agents, and brokers. While Acrez conducts a preliminary internal review for completeness and format, it does not verify legal title, encumbrances, ownership disputes, or government approvals. Users are solely responsible for conducting independent legal, technical, and on-site due diligence prior to any transaction.

4.2 Listing Categories

Listings may appear under the following categories, which are designations of source only and do not imply any verification, endorsement, or certification by Acrez:

  • Owner Listed — Submitted directly by the landowner or a verified nominee.
  • Agent Listed — Posted by a registered agent or broker with claimed access to the property.
  • Facilitated — Listed by Acrez on behalf of owners under a facilitation arrangement.

4.3 Verified Badge — Scope and Limitations

The 'Verified' badge displayed on listings indicates that Acrez has completed its internal preliminary review: document submission check, seller identity confirmation, and survey number cross-reference. This badge is a trust-signal indicator only.

IMPORTANT: The Verified badge does not constitute a legal certification of ownership, confirmation of clear title, absence of disputes or encumbrances, or any guarantee of the accuracy of listing details. Buyers must independently verify all legal and factual claims before transacting.

4.4 Seller Accountability

The Listing Party shall be solely and exclusively liable for all information provided in a listing, including claims regarding ownership, land measurements, approvals, and legal status. Acrez disclaims any and all liability arising from misrepresentations, false statements, fraudulent listings, or third-party disputes relating to any listed property.

4.5 Honorary and Platform Titles

Designations such as 'Top Agent' or similar titles are conferred solely on the basis of Platform engagement metrics. They do not create any principal-agent relationship, legal authority, employment relationship, or contractual partnership with Acrez.

4.6 Takedown Policy

Acrez reserves the right to delist any property upon receipt of a bona fide complaint supported by prima facie evidence of fraud, misrepresentation, or unauthorized publication. Takedown decisions are at the sole discretion of the Platform. Acrez also reserves the right to remove duplicate, misleading, or policy-violating listings without notice. Repeated violations may result in permanent account suspension.

5. USER CONDUCT & PROHIBITED ACTIVITIES

5.1 General Conduct

All Users are expected to conduct themselves in a lawful, ethical, and professional manner. Abusive language, threats, discrimination, unlawful activity, or unethical conduct toward other Users or the Acrez team is strictly prohibited and may result in immediate termination of access.

5.2 User-Generated Content

Users are solely liable for all Content submitted, uploaded, or published by them, including comments, messages, listing details, and documents. Acrez reserves the right, but not the obligation, to review, moderate, or remove any Content deemed offensive, false, unlawful, or in violation of these Terms. By submitting Content, Users grant Acrez a worldwide, irrevocable, royalty-free licence to use, reproduce, adapt, and distribute such Content for lawful purposes including Platform operations, marketing, and data analytics.

5.3 Prohibited Conduct

The following actions constitute a material breach of these Terms:

  • Misrepresentation of identity, property ownership, affiliation, or authority to list, including submission of forged documents or use of false credentials.
  • Harassment, abuse, threats, defamation, or intimidation of any User, Acrez representative, or third party through or in connection with the Platform.
  • Posting false, misleading, exaggerated, or fraudulent listings, including properties not legally owned, authorized for sale, or accurately described.
  • Manipulating listing details including location, price, size, or legal status.
  • Sending unsolicited messages, bulk communications, spam, or promotional Content through Platform tools.
  • Using the Platform to divert traffic, solicit funds, or promote external services not authorized by Acrez.
  • Circumventing or attempting to circumvent contact limits, paywalls, or subscription restrictions through technical means or account duplication.
  • Using the Platform in any manner that violates applicable local, state, national, or international laws or Third-party rights.

5.4 Electronic Communications Consent

By using the Platform, Users consent to receive communications from Acrez via email, SMS, WhatsApp, or push notifications. These may be transactional, service-related, or promotional. Users may opt out of promotional communications via Platform settings or by contacting support@Acrez.co.

6. PAID SERVICES & SUBSCRIPTIONS

6.1 Free Tier

Registered Users may access the Platform at no cost with the following limitations:

  • Up to 5 seller contact reveals per calendar month.
  • No access to the Government Data Plans.
  • No access to latest satellite imagery.
  • Unused free contacts do not carry over to the following month.

NOTE: The 5-contact free limit is a hard monthly cap. Users who reach this limit must upgrade to a paid subscription to continue accessing seller contact information within the same calendar month.

6.2 Paid Subscription Plans

Acrez offers Monthly and Annual subscription plans, with pricing as published on the Platform at the time of purchase. Premium features available to paid subscribers include:

  • Expanded contact access, subject to Acrez's fair use and anti-abuse limits as described in Section 6.3.
  • Full access to the Government Data plans.
  • Access to latest available satellite imagery for listed parcels.

6.3 Fair Use and Anti-Abuse Limits

Paid subscriptions provide expanded contact access for genuine land purchase activity. Acrez reserves the right to apply contact restrictions at any time, without prior notice, where the Platform's systems detect usage patterns inconsistent with genuine buyer behavior — including but not limited to: rapid sequential contact reveals, accessing a disproportionate number of listings across unrelated geographies, repeated contact of the same Listing Parties, or any pattern suggestive of data collection, lead harvesting, or bulk outreach.

Restrictions may be applied at the account level, are determined solely by Acrez, and may be temporary or permanent depending on the severity of detected misuse. Acrez is not obligated to disclose the specific thresholds or detection criteria that trigger such restrictions.

NOTE: Contact limits under this clause are not a fixed published cap — they are behavior-based. A User conducting genuine land purchase research will not encounter them. A User extracting data or spamming sellers will.

6.4 Payment Terms

All subscription fees are payable in advance in Indian Rupees (INR) via the payment methods available on the Platform. Subscriptions auto-renew unless cancelled before the renewal date. Acrez reserves the right to modify pricing with reasonable notice to active subscribers.

6.5 Refund Policy

Subscription fees are generally non-refundable. Acrez may, at its sole discretion, consider refund requests in the following limited circumstances:

  • A technical failure attributable to Acrez that rendered the Platform entirely inaccessible for a significant portion of the subscription period.
  • A verified billing error resulting in an incorrect charge.

Refund requests must be submitted within 48 hours of the charge to support@Acrez.co. Acrez will evaluate requests within 14 working days. No refunds will be issued where the User has accessed contact reveals or premium features during the billing period, except in cases of verified billing error. Where applicable law (including the Consumer Protection Act, 2019) mandates a specific refund right, Acrez will honor that obligation.

6.6 Restriction on Commercial Use

Use of the Platform, its listings, data, and Services is strictly limited to personal, non-commercial land purchase evaluation. Unauthorized reproduction, resale, redistribution, or commercial exploitation of Platform Content — including using contact data for lead generation, bulk outreach, or CRM seeding — is expressly prohibited and may result in legal action and immediate account termination.

6.7 Subscription Termination

Acrez reserves the right to suspend, revoke, or terminate any subscription with or without notice in the event of: breach of these Terms; misuse of the Platform; or conduct deemed abusive, fraudulent, or detrimental to Platform operations. No refund shall be due upon termination for cause.

7. GIS & Mapping Tools

7.1 Data Sources

GIS and mapping data displayed on the Platform are derived from publicly available sources including Revenue Departments, municipal authorities, government gazette notifications, and media publications. Such data is compiled on a best-effort basis and is intended solely for general informational purposes.

7.2 Accuracy and Limitations

All map visuals, plot boundaries, and data overlays presented on the Platform are approximate representations and are not certified for legal, cadastral, or transactional purposes. Boundary lines and overlay data may not reflect the current legal or physical ground reality of any parcel.

7.3 No Legal Standing

GIS overlays, plot markings, and spatial visuals on the Platform do not constitute legal documentation, title verification, proof of ownership, or government certification. Users must obtain official land survey records or government-certified documents from competent authorities before acting on any map-based information displayed on the Platform.

7.4 Data Timestamps

Where feasible, Acrez will display the approximate date of last update for government data layers and satellite imagery. Users are responsible for verifying whether displayed data remains current with the relevant authorities.

7.5 Liability Waiver

Acrez expressly disclaims any and all liability — direct, indirect, or consequential — arising from reliance upon GIS data, plans, map overlays, satellite imagery, or government data layers. The Platform assumes no responsibility for inaccuracies, omissions, outdated spatial information, or decisions made on the basis of such data.

8. Communication & Buyer- Seller Interation

8.1 Platform as Intermediary

Acrez provides tools that enable Users to initiate contact with Listing Parties via WhatsApp or direct call. Acrez does not participate in, monitor, record, or assume responsibility for the content, quality, accuracy, or outcome of communications between Users and Listing Parties. Users engage with each other at their sole risk and discretion.

8.2 No Transaction Guarantee

Acrez does not guarantee that any enquiry made through the Platform will result in a transaction, viewing, or response from the Listing Party. Acrez is not responsible for the conduct, responsiveness, or representations of any Listing Party after contact details are revealed.

8.3 Dispute Between Users

Any disputes arising between Users are solely between the parties concerned. Acrez is not a party to any transaction and shall bear no liability for losses, damages, or disputes arising from User-to-User interactions, whether before, during, or after a property transaction.

9. Liability, Indemnity & Legal Safeguards

9.1 Platform Use at User's Risk

The use of the Platform and its Services is entirely at the User's sole risk. Acrez makes no express or implied warranties, including but not limited to: accuracy of listing information, title status of any property, merchantability, fitness for a particular purpose, uninterrupted availability, or freedom from technical errors or defects.

9.2 Indemnity

Users agree to fully indemnify, defend, and hold harmless Acrez, Shashwat Technologies, their affiliates, officers, employees, and agents against all losses, claims, liabilities, penalties, costs, or proceedings arising from: (a) inaccurate, false, or misleading Content submitted by the User; (b) any illegal, unauthorised, or unethical use of the Platform; (c) breach of these Terms or applicable law; or (d) any transaction entered into in reliance on Platform Content.

9.3 Limitation of Liability

To the maximum extent permitted by applicable law, Acrez's total cumulative liability for any claim arising from use of the Platform shall be strictly limited to the total subscription fees actually paid by the User to Acrez in the six (6) months immediately preceding the claim. In no event shall Acrez be liable for indirect, incidental, consequential, punitive, or special damages, including loss of profits, loss of data, or loss of goodwill, even if advised of the possibility of such damages.

9.4 Legal Notices

All notices, claims, or communications with legal effect must be submitted to support@Acrez.co or via registered post to Shashwat Technologies at the address published on the Platform. Such communications shall be deemed received only upon confirmed delivery.

9.5 Waiver

No failure or delay by Acrez in exercising any right or remedy under these Terms shall constitute a waiver. A waiver shall only be effective if expressly provided in writing and signed by an authorized representative of Shashwat Technologies.

9.6 Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, such provision shall be deemed modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.

9.7 Survival

Notwithstanding termination or suspension of a User's access, all provisions relating to intellectual property, disclaimers, indemnities, limitations of liability, dispute resolution, and governing law shall survive and remain enforceable.

10. Governing Law & Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

10.2 Amicable Resolution

In the event of any dispute arising out of or relating to these Terms or use of the Platform, the parties shall first attempt resolution through good-faith mutual discussion within thirty (30) days of written notice of the dispute.

10.3 Arbitration

If the dispute is not resolved amicably within thirty (30) days, it shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996 (as amended). The seat and venue of arbitration shall be Ahmedabad, Gujarat. The arbitration shall be conducted by a sole arbitrator mutually agreed upon by the parties, or appointed by the relevant authority in the absence of agreement. Proceedings shall be conducted in English. The arbitral award shall be final and binding.

10.4 Jurisdiction for Interim Relief

Notwithstanding the arbitration clause, either party may seek urgent interim or injunctive relief from courts of competent jurisdiction in Ahmedabad, Gujarat, pending constitution of the arbitral tribunal or in aid of the arbitration.
